LATEST INTERNATIONAL CRIMINAL COURT DECISION ON ISRAEL: ABIM URGES IMMEDIATE ACTION TO BE TAKEN

Muslim Youth Movement Malaysia (ABIM) has been monitoring the issue of
infringement of international laws and United Nations Security Council Resolution by
Israeli government on the illegal occupation in the Palestinian territory since 1967.


ABIM has been consistently urging the International Criminal Court (ICC) to enforce
United Nations Security Council Resolution 2334 by initiating legal proceeding
against Israel promptly. Resolution 2334 reaffirmed the UNSC’s stand that the
establishment by Israel of settlements in the Palestinian territory occupied since
1967, including East Jerusalem, is illegal and constitutes a flagrant violation under
international laws. The resolution serves as a strong basis for the Office of The
Prosecutor (OTP) to request authorization from the ICC pre-trial chamber for its
office to initiate an investigation into the alleged crimes of Israel against Palestinians
in accordance with Article 15 (1) of the Rome Statute.


ABIM welcomes the latest development by the International Criminal Court (ICC) on
5th February 2021 through a majority ruling by judges in Pre-Trial Chamber I
contending that the Court’s territorial jurisdiction in the Situation in Palestine, a State
party to the ICC Rome Statute, extends to the territories occupied by Israel since
1967, namely Gaza and the West Bank, including East Jerusalem.


It is worth to note that all states must abide by the principles of rule of law and
international justice including Israel, regardless of its status as a non-states party to
the Rome Statute of the International Criminal Court.


In the same vein, ABIM believes that the decision serves as a beacon of hope for
Palestinians and every human being to be protected from any oppressions,
persecutions, and violations of fundamental rights.

Therefore, ABIM urges all international communities to unequivocally support the
bold decision made by the Pre-Trial Chamber I of International Criminal Court to
uphold international justice and rule of law, and reiterates that prompt action must be
taken against anyone violating the principles without bias.
