4 November 2015, Mahkamah Jalan Duta:- Hari ini, mewakili Angkatan Belia Islam Malaysia, memfailkan permohonan semakan kehakiman ke atas tiga responden:
1) Dato Seri Mohd Najib Tun Razak, Perdana Menteri,
2) Menteri Perdagangan Antarabangsa dan Industri, dan
3) Kerajaan Malaysia.
ABIM FILES JUDICIAL REVIEW TO SEEK THE GOVERNMENT TO HALT THE TPPA4 NOVEMBER 2015/ 22 MUHARRAM 1437 HToday, 4 November 2015, at the Jalan Duta High Court, Kuala Lumpur, The Muslim Youth Movement of Malaysia (ABIM) has filed an application for a Judicial Review against Yang Amat Berhormat (YAB) Prime Minister of Malaysia, Datuk Seri Mohd Najib Bin Tun Haji Abdul Razak, the Minister for International Trade and Industry and the Government of Malaysia named as respondents concerning the Trans-Pacific Partnership Agreement (TPPA) between Malaysia, Australia, Brunei, Canada, Chile, Japan, Mexico, New Zealand, Peru, Singapore and the United States. This application for judicial review is made because we believe that the TPPA is bound to affect national sovereignty, upset the founding structure of the Federal Constitution as well as belittling our law and justice system. As an organization that uphold Islam as fundamental role in politics, economy and society, ABIM considers that the TPPA would affect the special position of Islam as the religion of the federation as enshrined in Article 3 of Federal Constitution.TPPA would also affect core principles of the nation such as the special rights and privileges of Malay and the indigenous people of Sabah and Sarawak (Article 153), the national language (Article 152), Malay land reserve (Article 9) and several articles as well as legal policies which touches upon the environment, workers rights and welfare and health and safety issues in the event of legal proceedings by foreign companies in Malaysia. As an example, through the Investor-State Dispute Settlement (ISDS) mechanism for arbitration in order to ensure TPPA’s functionability, respondents maybe subject to legal action if they were to enforce certain policies which might be part of the Federal Constitution.In other words, ISDS which is contained in the TPPA would recognize special privileges for investors above the Federal Constitution and at the same time expose the respondents to various possibilities of legal action by these foreign investors.If such were to happen, it shall surely affect national sovereignty where the core values of the nation which are spelt out in the constitution are thus subject to be potentially challenged by foreign investors.Therefore, we believe that in the TPPA, foreign investors’ interest may supercede the Federal Constitution and our national justice system as every policy and legislature enforced or intended by the respondents are subject to being challenged.This application for judicial review is made because we are concerned that the TPPA maybe ratified without parliamentary approval and without divulging the contents of the agreement to the public. It means that the TPPA is considered officially legitimate and valid as accepted by the government of Malaysia. Upon this basis, an application for judicial review is filed for the following matters:- 1) We seek a mandamus order compelling the respondents to immediately reveal and make public the text of the Trans-Pacific Partnership Agreement (“TPPA Agreement”) and submit it to us and the general public; 2) We seek a mandamus order compelling the respondents to reveal and make public all documents related to the negotiation processes of the TPPA, reports and summaries including full cost and benefit analyses in signing the TPPA; 3) We seek a declaration that signing the TPPA agreement is an action which is against the Federal Constitution; 4) We seek the High Court to issue a prohibition order to prevent the First, Second and Third Respondents through themselves or their agents from signing the TPPA agreement;5) We seek an order for stay against the respondents from continuing with the processes of signing the TPPA agreement until this judicial review is heard upon merit and disposed by this honourable court. Ada beberapa pertimbangan yang dibuat sebelum memulakan tindakan mahkamah ini, antaranya isi perjanjian TPPA yang telah disimpulkan oleh kerajaan pada 5 Oktober lepas, dipercayai boleh memberi kesan kepada struktur asas Perlembagaan Persekutuan, antaranya merujuk kepada kedudukan Islam sebagai agama utama persekutuan yang termaktub dalam Perkara 3 Perlembagaan, selain hak-hak Keistimewaan Orang Melayu dan orang-orang asal Sabah dan Sarawak (Perkara 153), bahasa kebangsaan (Perkara 152), dan tanah rizab Melayu. Atas dasar ini, permohonan semakan kehakiman difailkan atas perkara-perkara seperti berikut:-
1) satu perintah mandamus bagi mewajibkan Responden-responden untuk dengan serta-merta menzahirkan dan mendedahkan teks Perjanjian Perkongsian Trans-Pasifik (“Perjanjian TPPA”) dan menyerahkannya kepada kami dan rakyat secara umum;
2) satu perintah mandamus bagi mewajibkan Responden-responden untuk dengan serta-merta menzahirkan dan mendedahkan segala dokumen yang berkaitan proses rundingan Perjanjian TPPA dari peringkat permulaan sehinggalah Perjanjian TPPA dilaporkan disimpulkan termasuk semua set analisis penuh kos dan faedah menandatangani Perjanjian TPPA;
3) satu deklarasi bahawa menandatangani Perjanjian TPPA adalah suatu tindakan yang bercanggah dengan Perlembagaan Persekutuan;
4) suatu perintah larangan (prohibition) bagi melarang Responden Pertama, Kedua dan Ketiga sama ada melalui dirinya sendiri atau agennya atau wakilnya daripada menandatangani Perjanjian TPPA;
5) satu perintah penggantungan terhadap Responden dari meneruskan dengan proses menandatangani Perjanjian TPPA terse
but sehingga Semakan Kehakiman ini didengar di atas meritnya dan diputuskan oleh Mahkamah Yang Mulia ini. Ini adalah suatu keputusan yang berat dibuat, tetapi demi kebaikan negara yang tercinta ini ianya terpaksa dilakukan jua. moga-moga pasukan ini diberikan kemudahan dan pertolongan oleh Allah SWT.
